Will Dr Ranson v DHSC 2 Happen?

It appears that no decision has been reached over whether Dr Rosalind Ranson will continue with her second complaint against the DHSC.

Dr Ranson was found to have been unfairly dismissed after whistleblowing when she was employed as the island’s senior medic, a tribunal awarded her £3.2m.

In June, the tribunal chair, having expressed his frustration over this second ‘bite of the cherry’ said that parties should go away to discuss the matter before deciding whether to continue.

The tribunal published a report which said: ‘During the Hearing, the Chairman proposed that there be time permitted to enable the parties to talk to each other about the future of the Second Complaint and this approach was supported by both KCs.

‘Accordingly, the Tribunal now permits the parties until 4PM on July 10 2023 in which to investigate whether the Second Complaint can be settled, withdrawn or whether it will be necessary to proceed to Mr Devonshire’s (DHSC lawyer) strike-out application.’

As such, with July 10 having come and gone, we expected to know what was happening, whether the second complaint was to be continued with and, in turn, whether the DHSC would seek to have it thrown out.

Despite this, no decision appears to have been reached.

A DHSC spokesperson said: ‘The Order from the Tribunal of  June 19 2023 simply provided a set period of time for the parties to have some breathing space and to talk about the future of the Second Claim.

‘The outcome of those discussions will determine whether or not the matter needs to go back before the Tribunal; however, for the time being there is no further decision to report.’
